Terms of Service

These Terms of Service ("Terms") govern your access to and use of Ask & Chart (the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you accept these Terms for that organization and confirm you are authorized to do so.
1. Who we are
The Service is provided by Athanix OÜ ("Ask & Chart", "we", "us"), the company you contract with when you use the Service. Our registered office, registry code and other registered details are in the Legal Notice.
2. The Service
Ask & Chart is a data platform for small and mid-sized teams: you pour in the files, exports and database connections you already have, the platform profiles them and proposes how they connect, you confirm the joins, and you ask questions in plain language and see charts and dashboards computed deterministically from your own data. The AI proposes queries and connection candidates; it never produces a figure. Features vary by plan and may change as we improve the Service.
3. Accounts and eligibility
You must provide accurate information when you sign in and keep your account and sign-in inbox secure. You are responsible for all activity under your account. You must be at least 16, or the age of digital consent in your jurisdiction, to use the Service.
4. Acceptable use
You agree not to use the Service to:
- process data you do not have the right to process, including personal data you have no lawful basis to hold;
- upload or distribute malware, or attempt to breach security or access controls, probe or scan the Service except through documented interfaces, or place an unreasonable load on it;
- connect a database or source you are not authorized to access;
- misrepresent figures computed by the Service as something they are not, or remove provenance from them when presenting them as output of the Service; or
- violate any applicable law or third-party right.
Where we reasonably believe these Terms are breached or that your use creates risk or legal exposure, we may suspend an account or disable access to specific content, with or without prior notice depending on the severity.
5. Your data
You retain ownership of the files, database extracts, models, dashboards and other content you pour into or build in the Service ("Your Data"). You grant us a limited, worldwide, non-exclusive license to host, process, transmit and display Your Data solely to operate and improve the Service for you. We do not sell Your Data, and we do not use it to train third-party models.
6. Data protection
For the account data we hold about you, Ask & Chart is the controller, as described in our Privacy Policy. For the business data you pour into your workspace, which may include personal data (for example payroll rows or assignee records), you are the controller and Ask & Chart is your processor: we process it only on your instructions to operate the Service, as set out on our Legal page. You are responsible for having a lawful basis for the personal data you pour in and for the notices its data subjects require.
7. Subscriptions, billing, refunds, and taxes
Paid plans are billed in advance through our payment processor, Stripe, at the prices shown at checkout and on the pricing page. Subscriptions renew automatically until cancelled; you can cancel at any time and keep access through the end of the paid period. We are not currently subject to VAT collection. Where taxes apply, Stripe computes them automatically from the billing location. Except where required by law, payments are non-refundable. The free tier requires no payment details.
8. Service changes and availability
We may add, change, or remove features as the Service evolves. We aim to keep the Service available and to recover from failures without data loss, but except where a separate service-level commitment applies to your plan, the Service is provided without an uptime guarantee.
9. Intellectual property
The Service, including its software, design, and trademarks (including Ask & Chart), is owned by us and our licensors. These Terms grant you no rights to our brand or software beyond using the Service as intended.
10. Third-party services
The Service integrates with third-party services such as payment, email, hosting and AI model providers, and sources you choose to connect. Your use of those services is subject to their terms, and we are not responsible for them.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the maximum extent permitted by law. Figures the Service computes are only as good as the data you pour in and the joins you confirm; the Service shows provenance so you can verify them, and you remain responsible for decisions you take on them.
12. Limitation of liability
To the maximum extent permitted by law, Ask & Chart is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred US dollars. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
13. Indemnification
You will defend, indemnify, and hold harmless Ask & Chart and its personnel from claims, damages, and costs (including reasonable legal fees) arising out of the data you process through the Service, your breach of these Terms, or your violation of any law or third-party right.
14. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, misuse the Service, or create risk or legal exposure. On termination you can export Your Data for a reasonable period before it is deleted, except where we must retain data by law.
15. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including outages of infrastructure or third-party providers, network failures, acts of government, or natural events.
16. Governing law and disputes
These Terms are governed by the laws of Estonia, without regard to conflict-of-laws rules, and its courts have jurisdiction over any dispute. If you are a consumer, you keep the benefit of any mandatory protections of your country of residence and any right that the law of that country gives you to bring proceedings in its courts.
17. Assignment
You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets, on notice to you.
18. General
If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and the Legal page, are the entire agreement between you and Ask & Chart regarding the Service and supersede prior agreements on that subject.
19. Changes to these Terms
We may update these Terms as the Service evolves. If we make material changes, we will notify you through the Service or by email. Continued use after changes take effect constitutes acceptance.
